Permohonan Dr. Syed Husin Ali dan 8 lagi Pertimbang

bubarkan PRM Ditolak dengan Kos

Pada 16 Julai 2009, Hakim Mahkamah Tinggi Sivil, Mahkamah Tinggi Malaya di Kuala Lumpur Bahagian Rayuan dan Kuasa-Kuasa Khas 1, Yang Arif Puan Low Bee Lan telah menolak dengan kos permohonan Dr. Syed Husin Ali dan 8 lagi supaya dibatalkan perakuan pendaftaran nama pertubuhan : Parti Rakyat Malaysia (PRM). Tulisan Kehakiman akan dikemukakan. Walau bagaimanapun pemohon-pemohon boleh mengemukakan rayuan dalam tempoh 14 hari.

Keputusan tersebut di atas dibuat setelah peguam-peguam yang mewakili pemohon dan responden memberikan hujah untuk kali terakhir dalam kamar petang ini dari pukul 3.30 petang ke 5.50 petang.

Peguam pemohon ialah Cik Ranuka a/p Balasubramaniam, manakala responden pertama dan kedua diwakili Peguam Persekutuan Encik Norhisham bin Ismail, dan responden ketiga hingga ke-12 (pencelah) diwakili oleh Encik G.K. Ganesan (lead council), Encik K. Palaniandy dan Encik Hassan Abd. Karim.

Hassan karim selaku presiden PRM menyatakan selepas selesainya perbicaraan bahawa permohonan bekas pemimpin PRM yang telah menyertai Parti Keadilan Rakyat untuk membatalkan pendaftaran PRM ditolak dengan sebab-sebab berikut.

Pertama, Pendaftar Pertubuhan Malaysia (ROS) telah membuat keputusan “tidak dapat diberi pertimbangan” terhadap permohohan pemohon untuk membubarkan PRM dalam surat jawapan kepada Dr Sanusi Osman bertarikh 11 Mei 2005.

Kedua, sebabnya pertimbangan membubarkan PRM tidak dapat diberi ialah undang-undang berdaftar iaitu Perlembagaan Parti Rakyat Malaysia (PRM) tidak mempunyai peruntukan membubarkan parti. Dalam keadaan ini, Peruntukan 9(h) Akta Pertubuhan 1966 hendaklah dipakai jika PRM hendak dibubarkan. Peruntukan 9(h) menyatakan supaya satu mesyuarat khas ahli-ahli PRM diadakan dan usul pembubaran PRM mesti hendak dilulus oleh sekurang-kurangnya 60 % daripada semua ahli PRM. Bekas kepemimpinan PRM tidak mengadakan mesyuarat khas ahli ini.

Ketiga, sekiranya pemohon-pemohon tidak berpuas hati dengan mana-mana keputusan ROS, mereka hendak terlebih dahulu mengikuti Peruntukan 18 Akta Pertubuhan 1966 dalam tempoh satu bulan membuat rayuan kepada Menteri Dalam Negeri setelah ROS menolak permohonan untuk membubarkan PRM, tetapi mereka tidak berbuat demikian.

Keempat, pemohon-pemohon tidak ada locus standi kerana mereka telah meninggalkan parti menyertai PKR. Semasa membuat permohonan semakan kehakiman ini, pemohon bukan ahli-ahli PRM lagi.

Oleh sebab itu, pemohon-pemohon belum menghabiskan remedy yang diperuntukkan dalam Akta Pertubuhan 1966 semasa memohon semakan kehakiman di mahkamah supaya pendaftaran PRM dibatalkan kononnya PRM dan Parti Keadilan Nasional telah bercantum dan sebuah parti baru yang bernama PKR terlahir.

Pada 9 Januari 2006, Hakim Mahkamah Tinggi Sivil, Mahkamah Tinggi Malaya di Kuala Lumpur Bahagian Rayuan dan Kuasa-Kuasa Khas 1, mendiang Yang Arif Datuk Ganga Dharan telah memberi satu perintah mandamus untuk mengarahkan Pendaftar Pertubuhan Malaysia supaya menimbang dan membuat satu keputusan berdasarkan undang-undang yang sedia ada terhadap permohonan pemohon-pemohon melalui Borang 6 bertarikh 14hb April 2005 untuk membubarkan pendaftaran Parti Rakyat Malaysia. Afidavit permohonan Dr Sanusi bin Osman dan 8 lagi untuk semakan kehakiman ini diikrarkan pada 26 September 2005.

Oleh sebab semakan kehakiman tersebut melibatkan kepentingan dan hak kebebasan berorganisasi ahli-ahli PRM, Hakim Mahkamah Tinggi Sivil yang sama telah meluluskan permohonan 10 orang ahli PRM untuk mencelah dalam proses semakan kehakiman ini pada 9 Januari 2007.

Pemohon untuk semakan kehakiman ialah Dr. Syed Husin Ali, bekas Presiden PRM kini Timbalan Presiden Parti Keadilan Rakyat (PKR), Dr. Sanusi bin Osman, bekas Setiausaha Agung PRM and pernah menyandang Ahli Majlis Parti Tertinggi (MPT), Sivarasa Rasiah bekas Naib Presiden PRM dan kini Naib Presiden PKR merangkap ahli Parlimen Subang, Lam Yong Pang @Lim Yoon Pang bekas ahli Jawatankuasa Pusat (AJKP) PRM, Ban Ah Kam pernah dilantik ahli MPT PKR, Tai Kim Tat bekas AJKP PRM, Latheefa Beebi Koya bekas AJKP PRM dan kini ahli MBPJ merangkap Ketua Penerangan PKR, Faizal bin Sanusi bekas ketua Angkatan Muda PRM dan Angkatan Muda PKR, dan Parti Rakyat Malaysia.

Pencelah ialah ahli-ahli PRM Koh Swe Yong, Zulkarnain bin Abdullah, M. Shariff bin Attan, Saleh bin Sikun, Mohd Salleh bin Haji Ahmad, Abd Jalil bin Ahmad, Ahmad Aidit bin Abdullah, Tan Cheng Hong, Chin Kooi Chong, dan Wong Hoy Chow.

PRM menyeru pengundi Kawasan DUN Manek Urai memberi sokongan sepenuhnya kepada calon PAS

Parti Rakyat Malaysia (PRM) menyeru pengundi Kawasan DUN Manek Urai memberi sokongan sepenuhnya kepada calon PAS , Abe Uji, dalam pilihan raya kecil (PRK) ini.


Barisan Nasional (BN) khususnya pemimpin UMNO kini banyak bercakap tentang nasib dan kepentingan “ rakyat ”, misalnya “kalau kami tidak berubah, rakyat akan mengubah kami”.


Kepimpinan ini juga mencuba sedaya upaya memperlihatkan kelainan dalam tindak-tanduk mereka dengan perubahan. Walaupun pucuk pimpinan UMNO dan kerajaan BN diterajui oleh pemandu baru , tetapi pemandu ini bukan muka baru. Kepimpinan baru ini mempunyai rekod trafik yang kurang baik.


Pada keseluruhannya, perbezaan dan perubahan baru dalam stail kepimpinan itu sebenarnya tidak membawa manfaat dan faedah bernas kepada rakyat jelata. Mereka hanya gimmik politik untuk mempakej imej UMNO- BN dalam pakejing baru untuk menutup pekong dan nanah mereka. Dengan demikian, mereka hendak menawan balik kepercayaan dan sokongan rakyat negara ini terhadap mereka.


Tindakan terbaru BN-UMNO memansuhkan PPSMI menunjukkan dasar yang digubal hanya oleh seorang tokoh UMNO itu sahaja tidak berfaedah langsung kepada rakyat dan negara. Dasar PPSMI sepatutnya ditolak pada peringkat disebut-sebut , tetapi oleh sebab pemimpin UMNO sekarang ini hanya menjaga kedudukan dan kepentingan diri mereka dalam cabinet pada ketika dasar itu dibentangkan. Mereka tidak ada perkataan “kepentingan rakyat” dalam kamus mereka, mereka pun menyokong penuh dasar yang kemudiannya dibantah dan ditentang kuat oleh kebanyakan rakyat negara ini.


Pada pendapat PRM, rakyat perlu berwaspada kerana walaupun telah diumumkan PPSMI dimansuhkan, tetapi pemansuhannya hanya berkuatkuasa pada tahun 2012, iaitu tarikh itu jatuh pada PRU ke-13. Apa-apa boleh berlaku dalam masa ini. Rakyat perlu juga bertanya, kenapa pengajaran matematik dan sains dalam Bahasa dan Bahasa ibunda tidak dimulakan pada tahun depan di darjah satu?


Oleh itu, pengundi Manek Urai harus menolak calon UMNO-BN sama sekali dalam PRK ini supaya UMNO-BN tidak lagi pandai-pandai bermain gimmik politik.

Are we ready for a two-party system?

FOR more than 50 years, the Barisan Nasional (BN) has used an array of laws and methods to silence dissent and perpetuate its own vision of reality as the only truth. But in recent years, the scenario has changed. The BN is now being challenged by bloggers and other citizens who are highly critical of the government, even to the extent of dismissing any attempts by the BN to rectify its wrongs.

Trust towards the government is gone, and no one has a definite answer on how to regain this trust. It's like a personal betrayal where your partner or spouse has had an affair: after that, trying to rebuild trust may take ages. Just ask the urban youth — a vast number do not like the government. And these are potential, future voters.

Perhaps the best way out is for the opposition to win in the next general election and form a new government while the BN becomes the opposition, like in two-party systems in some Western countries. But the question is, are we prepared for this? Are Malaysians mature enough to be able to weigh different perspectives? Can we do this without turning irrational and resorting to bashing personalities, issuing religious rulings and threats, or even becoming violent?

The worrying trend in Malaysia now is that we are divided into two main opposing camps. Two big unmoving blocks. Both sides seemed to endorse the view that "if you are not with us, you are against us". This is an archaic view, a carry-over from the politics of the 1960s that if a fence has two sides, you are either on this side or that side. It does not make room for compromise.

Can everyone be bought?

Before 2008, when the BN had almost absolute power, independent candidates for any elections were mainly viewed as irritants and nuisances. People thought they only tended to split the votes because almost all of them obtained negligible votes, and many lost their deposits.

But after the March 2008 elections, especially when Parti Keadilan Rakyat (PKR) and its Pakatan Rakyat (PR) partners led several state governments and became stronger, they too are now highly suspicious of independent candidates. Now, the PR spreads rumours like wildfire that independent candidates are government agents and are paid millions by the BN. The longer the rumour runs, the bigger the sum seems to get.

The rakyat loves this and laps it up as inalienable truth. Yes, for some candidates, these allegations might be true. But we cannot simply generalise. I've got into some heated arguments over this. My opponents contended that if millions were placed before me, what would I do? Would I not be bought if I saw this huge amount in front of my eyes or in my bank account?

So the assumption here is that everyone has a price. I do not agree. What of people who have sacrificed their lives for their beliefs? Take Ernesto Che Guevara, who gave up a ministerial post in Cuba and went back to the jungles of Latin America because he believed in liberating its people.

What of Dr Norman Bethune (1890-1939), a Canadian physician who sacrificed his entire life to serve the people of China during the Sino-Japanese war when he could have made tons of money as a doctor in the West?

What of Ajahn Brahm, a nuclear scientist from Cambridge who could have led an upper-class life but went on to became a Buddhist monk instead? This was also true of a French Buddhist monk, Matthieu Ricard, who had a doctorate in biology from the prestigious Pasteur Institute, but gave up his material comfort for his ideals.

And there are others who are willing to sacrifice material comfort to stand by their ideals.

It follows that since there are now more political spaces, it makes sense for independent people who are concerned citizens to stand for election. Blogger Raja Petra Kamarudin says he cannot think like a politician because they tend to side with their political parties. He says he is a social activist who wants to be free from political bindings.

Although I do not condone all his views, to some extent, I do agree with him on this one, because independent thinkers could be writers, could be in non-governmental organisations, and should be in politics.

It's black, it's white

Observe what's happening in our Parliament today. When a BN component party suggests a certain policy or law, and it comes to voting time, all MPs vote along their respective party lines.

A similar response can be seen when suggestions and views come from the PR. There is really no independent voting because we hardly have any independent parliamentarians, except Ibrahim Ali and possibly Dr Michael Jeyakumar Devaraj of the Socialist Party of Malaysia, who could be a moderating factor.

The question is, why can't we have more independent candidates in Parliament who will not toe any party line? People who would be able to analyse policies and plans to see if they are for the benefit of the public, based on principles and integrity?

When an independent candidate stands for elections, the majority of our voters prefer to elect the political party and not for the candidate. For example, in the recent Penanti by-election, only 46% went out to vote. Why couldn't those who abstained from voting overlook the fact that although the BN did not field a candidate, there were three independent candidates contesting against PKR?

It is timely now that Malaysians listen to the candidate and his or her written manifesto, and if he or she wins, ensure that his or her promise is kept. Similarly, candidates from political parties shouldn't compromise their promises to abide by their main party's plans and policies.

When a person becomes an independent candidate either in the state assembly or Parliament, there is a real danger that much inducement will be offered either by the BN or the PR, or both. Hence, such temptations will become the biggest test for an independent candidate, a pull between one's conscience and idealism on one hand and on the other, material comfort and greed.

Jeopardising Pakatan Rakyat?

The other heated argument that I got into is, why must we jeopardise the attempts of the PR to overthrow the BN? When I argued that a third voice and a conscience must always be present in any political process, my opponent dismissed it as irrelevant.

Have you come across people in this country who scream and shout for democracy but cannot tolerate someone else's differing viewpoint? Have you come across advocates of democracy in the public sphere who cannot practise it in their daily lives and in the domestic sphere? This is something I fear is happening to proponents of an absolute two-party system who cannot see the value of other independent voices.

However, people should not be cowed into accepting the majority's point of view because the majority is not always right. Given some education and experience, people should have the freedom to practise what they believe, state their opinions, learn to accept differences in opinion, and accept responsibility for their beliefs and actions.

After all, this is what democracy is all about — an inalienable right for everyone, immaterial of their gender, ethnicity and age, to express and act freely but responsibly.

Malaysia harus menghormati Perjanjian Perdamaian 2/12/1989 dengan Parti Komunis Malaya (PKM)

Benarkan Chin Peng pulang ke Malaysia



Kerajaan Malaysia harus menghormati Perjanjian Perdamaian yang dimeterai antara kerajaan Malaysia dengan Parti Komunis Malaya (PKM) pada 2 Disember 1989 di negeri Thai dan membenarkan Chin Peng pulang ke Malaysia seperti beratus-ratus ahli PKM lain yang telah balik ke negeri ini di bawah Perjanjian Perdamaian tersebut.


Parti Rakyat Malaysia berpendapat Kerajaan Malaysia harus menghormati perjanjian yang dibuat dengan mana-mana pihak jika Kerajaan Malaysia hendak memperlihatkan kewibawaannya dalam mata rakyat sendiri dan mata dunia.


Parti Rakyat Malaysia percaya memandangkan sejarah dan situasi pencapaian kemerdekaan Malaysia dan perkembangan seterusnya, Kerajaan Malaysia ketika berunding dan akhirnya memeterai Perjanjian Perdamaian dengan PKM bukan tidak menghadapi pelbagai reaksi daripada pelbagai golongan dalam negeri.


Walaupun begitu, pemimpin kerajaan yang mengambil langkah untuk berdamai tahu masalah PKM adalah masalah politik dan akhirnya perlu diselesaikan secara politik, justeru itu bertekad mengambil langkah politik untuk menrealisasikan perdamaian dalam negeri ini.


Di bawah suasana pelbagai reaksilah Perjanjian Perdamaian dicapai. Tidak hairanlah jika ada pihak bersuara menyokong dan ada pihak menentang apabila hal Chin Peng timbul di khalayak ramai. Inilah demokrasi.


Apa lagi, selama ini kerajaan beruar-uar hendak membina masyarakat penyayang. Jika kita tidak dapat menerima seorang orang tua dalam pangkuan kita, manalah semangat masyarakat penyayang.


Parti Rakyat Malaysia berpendapat, selepas 50 tahun Malaysia telah merdeka dan selari dengan trend globalisasi, adalah masanya masyarakat dan kerajaan negara ini menerima hakikat bahawa dalam masyarakat demokrasi dan moden, pandangan-pandangan yang berlainan dengan diri kita sendiri harus dibenarkan wujud dan tidak harus disekat.

113 groups alarmed about death of 2 migrants in Detention Centre

DEATH OF 2 BURMESE INDICATIVE OF STATE OF DETENTION PLACES IN MALAYSIA

DENIAL OF HEALTHCARE IS A VIOLATION OF RIGHT TO LIFE

We, the undersigned, are alarmed to hear that Sa La Hin, 26, and Thang Hoih Ping, 21, two Burmese migrants, have died in the Malaysia’s Juru Immigration Detention Centre from Leptospirosis. This is disease that is usually caused by exposure to water contaminated with the urine of infected animals, such as rodents, cattle, pigs, horses, dogs and wild animals. The fact, that 2 persons are dead and others have been infected by this disease, again highlights the state of hygiene, cleanliness and healthcare at Malaysian Detention Centres.

We recall that it was reported in the media in December 2008, that "About 1,300 illegal foreigners have died during detention in the past six years, Malaysia Nanban quoted Malaysian Human Rights (Suhakam) commissioner Datuk N. Siva Subramaniam as saying. He said many of them died in immigration detention centres, prisons and police lockups because they were denied medical treatment at the right time.” [Star, 18/12/2008, ‘1,300 foreign detainees died due to neglect’]. Now, Sa La Hin and Thang Hoih Ping may just be the latest additions to that list of detainees that died due to similar reasons.

We also recall the words of SUHAKAM in their response to the Asian Human Rights Commission (AHRC) dated 13/1/2009, that correctly stated that ‘…SUHAKAM views the denial of medical attention to the point of endangering one’s life as a serious violation of that person’s right to life….’

These deaths may have been avoided if medical attention was provided promptly, and we call for an independent public inquiry to determine whether there was such negligence on the part of the Ikatan Relawan Rakyat or better known as RELA (a People's Volunteer Corps), and the Immigration officers, who are currently responsible for Immigration Detention Centres in Malaysia.

We do appreciate the fact that the Director General of Immigration has now decided that ‘cleanliness and hygiene at immigration depots nationwide are to be stepped-up to ensure safety of staff and inmates there against contracting infectious diseases’ (Bernama, 19/5/2009, Cleanliness, Hygiene at Immigration Depot to Be Stepped Up).

We hope that this is not merely a knee-jerk response, which is temporary in nature, but a new and permanent commitment by Malaysia to improve standards and conditions of Detention Centres and other places of detention.

The current once a week visit by a medical officer to the Detention Centres is certainly inadequate. There should be, at the very least, a permanent clinic/dispensary manned by a medical assistant, with a doctor visiting detainees for several hours at least once every two days or more frequently.

New users of the Detention facility should also be determined free from easily transmittable diseases like Tuberculosis and the A(H1N1) flu before being introduced to the general population of detention places.

There should also be regular visits by the Health Officer, who shall monitor the conditions, including of the living and sleeping environment, of the Detention Centre to ensure that it meets the highest standards of hygiene and cleanliness.

The foods, and all aspects of food preparation, also need to be monitored by the Health Department especially since there is a possibility that the fault in the recent deaths could be the current caterer of food and drink.

With regard to those who have died, we are of the opinion that their family and/or dependents should be given adequate compensation by the persons responsible, the detaining authority and the Malaysian government.

Officers and persons responsible for the acts or omissions that resulted in death and suffering should be charged and prosecuted for these crimes. They should not be permitted to hide behind safeguards provided to public servants and/or the RELA volunteers, which unfortunately only promotes culture of impunity with no sense of responsibility and respect for human life.

We, the undersigned, call on the Malaysian Human Rights Commission (SUHAKAM) to immediately commence a public inquiry into these deaths and detention places generally, and come up with concrete recommendations which could be implemented that will improve state of cleanliness, hygiene and healthcare of all detention places in Malaysia.

We are also call upon the Ministry of Health and the government of Malaysia to take necessary steps to ensure that proper steps be taken to ensure that such disregard for life does not happen again.

We reiterate the call for the abolition of RELA, and restate our position that law enforcement, and management of detention places should be done by professionally trained full-time public servants, not volunteers.

人民党决定不参加本南地补选


马来西亚人民党总秘书辜瑞荣今天发表文告公布,马来西亚人民党中央工作委员会昨天讨论了多个团体和个别人士的意见包括槟城民联领袖的意见,决定不派候选人参加槟城本南地补选,并呼吁本南地选民全力支持民联候选人。


文告指出,在马来西亚人民党公布,决定参加本南地补选后,各方面人士联络了人民党中央和槟州负责人,并针对人民党决定参加本南地补选一事提出看法和批评。在这些意见里,有的支持,也有不同意人民党参加补选,并建议人民党支持民联。


虽然派候选人参加全国大选和补选是人民党的既定政策,党内和党外的意见和批评,在人民党作出决定要或不要参选时,也将成为人民党考虑的重要准绳之一。


对这次参加本南地补选课题,马来西亚人民党要在此感激所有联络并给与人民党宝贵意见和批评的各方人士。


人民党一如既往,坚决反对国阵实行的贪婪和只对一小撮当权精英有利的资本主义政策。人民党非常珍惜各方面的意见和批评。这些意见和批评,在人民党做出任何决策过程时,都会受到认真的考虑。最后,人民党呼吁所有反对国阵力量团结一致,否决国阵的执政权。

PRM tidak bertanding PRK Penanti


Jawatankuasa Pusat Parti Rakyat Malaysia (PRM) memutuskan supaya tidak bertanding dalam pilihan raya kecil Penanti semalam, dan menyeru pengundi-pengundi memberi sokongan penuh kepada calon Pakatan Rakyat setelah berbincang tentang pandangan organisasi-organisasi dan individu-individu termasuk pemimpin Pakatan Rakyat Pulau Pinang yang diterima PRM.


Setelah PRM mengumumkan keputusan untuk bertanding dalam PRK Penanti, pelbagai pihak telah menghubungi pemimpin pusat dan pemimpin negeri Pulau Pinang PRM. Antaranya, terdapat pandangan yang memberi sokongan kepada PRM, ada juga pendapat yang menasihati supaya PRM tidak meletakkan calon, sebaliknya memberi sokongan kepada Pakatan Rakyat.


Walaupun bertanding dalam mana-mana pilihan raya umum dan pilihan raya kecil merupakan dasar PRM, tetapi pandangan dalaman dan daripada luar parti juga menjadi kayu ukuran yang penting semasa PRM membuat keputusan sama ada masuk untuk bertanding atau tidak.


Jawatankuasa Pusat PRM ingin mengucapkan ribuan terima kasih kepada mana-mana pihak yang menghubungi PRM dan memberikan kata-kata nasihat kepada PRM terhadap keputusan PRM bertanding dalam PRK Penanti.


PRM seperti sediakala tetap menentang dasar kapitalis BN yang rakus dan hanya menguntungkan segelintir elit yang berkuasa. PRM amat menghargai teguran dan nasihat seperti tersebut di atas. Pandangan tersebut akan dipertimbangkan dengan serius dalam proses menentukan keputusan PRM. Dalam pada ini, PRM ingin menyeru tenaga-tenaga yang menentang dasar BN ini supaya bersatu dan nyahkan kuasa pemerintahan BN.
